Our Approach
A trade-mark search is always a prudent preliminary prior to filing. Some trade-marks are not registrable; a trade-mark is unregistrable if it is 'clearly descriptive or deceptively misdescriptive' of the wares and/or services, to which it is applied, or if it is confusing with a previously registered (or filed) trade-mark. Some such objections may be capable of being surmounted. We advise our clients of the merits of such objections and suggest measures that can be employed to achieve success.
